The petitioners apprehend their arrest in Kudhani P.S. Case No. 279 of 2016 instituted for the offence under Section(s) 304(B), 201, 34 of the Indian Penal Code. It has been submitted that husband of the deceased is already in custody. There is general and omnibus allegation against the petitioners.
It is alleged in the written report that daughter of the informant was married with Ritesh Kumar Singh three years prior to lodging of the present case. The victim was tortured and done to death for non-fulfilment of the dowry demand by her
Patna High Court Cr.Misc. No.6104 of 2017 (2) dt.17-02-2017 2/2 husband and other in-laws family members. The petitioners are said to be father-in-law, mother-in-law and brother-in-law of the victim.
From the written report, it appears that there is general and omnibus allegation. The husband of the victim is in custody.
Learned counsel for the informant appeared and opposed the prayer for bail of the petitioners. In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Kudhani P.S. Case No. 279 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
