2.The petitioner seeks bail in connection with Wazirganj P.S. Case No. 30 of 2007 registered for the offence under Sections 147, 148, 149, 307, 353, 414 of the Indian Penal Code and Section 25(1-b)A, 26, 27 and 35 of the Arms Act and 4/5 of the Explosive Substance Act and 17/18 of the C.L.A. Act. 3.Learned counsel for the petitioner submits that the petitioner is in custody since 16.07.2021, the petitioner is quite innocent and he has no criminal antecedent. 4.Learned A.P.P. has vehemently opposed the prayer for bail.
5.Earlier the bail application of the petitioner was rejected because the petitioner was absconder.
Patna High Court CR. MISC. No.46263 of 2023(2) dt.19-07-2023 2/2 6.Charges have been framed in the case on 18.07.2022 and after framing of charge no witness has been examined.
7.Considering the aforesaid facts, this application for regular bail is allowed.
8.Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Gaya/concerned Court below in connection with Wazirganj P.S. Case No. 30 of 2007 subject to condition that:- 8(i). One of the bailor should be close blood relative of the petitioner.
8(ii). The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
