The petitioner is apprehending arrest in a case registered for the offences punishable under sections 379/34 of the Indian Penal Code. Later, section 411 IPC was also added. On theft of construction materials from the construction site, the FIR was lodged against the petitioner. It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled and the recovered articles are of general nature when the son of the petitioner is a scrap dealer. It is further submitted that the recovered articles have not been put on Test Identification Parade. The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.34068 of 2015 (2) dt.24-08-2015 2/2 consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Mahesi P.S. Case No. 20 of 2015 pending in the court of learned JM Ist Class, Saharsa. This application is disposed of with the aforesaid observation/direction.
