2. The petitioner is apprehending his arrest in connection with Beldaur P.S. Case No.225 of 2023, registered for the offences punishable under Sections 341/323/ 504 /506 /447/354B/509/294/34 of the Indian Penal Code and under Sections 66(C)(E)/67(A) of the Information Technology Act, 2000.

3. It has been alleged in the FIR that the petitioner was used to take tuition in the family of the informant and he had taken vidoe of the informant's daughter and started putting pressure for marry. On refusal

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that dispute was going on between the informant and petitioner's uncle it is due to this reason case this been filed against him. He further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed.

5. Learned Counsel for the State opposes the prayer for anticipatory bail and submits that on the previous occasion case-diary was called for. From the case-diary the allegation made in the FIR has been accepted by the witnesses and it has been filtered that he was involved in taking video of the informant's daughter and subsequently make it viral. Under the various provisions of the I.T. Act, this Court offers the petitioner to deposit 50 percent of the fine amount subject to result of the trial. Counsel for the petitioner submits that petitioner is poor and he is not in a position to deposit the same.

6. As such, this Court has no option but to refuse the prayer for anticipatory bail of the petitioner with

Patna High Court CR. MISC. No.48243 of 2024(3) dt.21-09-2024 3/3 liberty that if in case the petitioner surrenders before the Court-below within four weeks from today, the Trial Court shall consider his prayer for bail on the same day without being prejudiced by the order of this Court.
