2. The petitioner is in custody in a case registered for an offence punishable under Sections 413 and 414 of the Indian Penal Code and Section 25(1-b)a, 26/ 35 of the Arms Act.

3. As per allegation made in the FIR, one countrymade pistol, two live cartridges and a mobile set were recovered from possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner and he has no concern with the alleged recovery. He has submitted further that co-accused Rohit Kumar has been granted

Patna High Court CR. MISC. No.51604 of 2024(2) dt.30-07-2024 2/2 regular bail by a coordinate Bench of this Court in Cr. Misc. No. 50154 of 2024. The petitioner is in custody since 04.04.2024.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S. Case No. 124 of 2024 subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) It is made clear that the petitioner shall not involve in the similar nature of offence, failing which, the State shall be at liberty to move before the Trial Court itself for cancellation of bail bond of the petitioner.
