JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420/34 of the Indian Penal Code.
The prosecution case is that the petitioner no. 2 being the son of petitioner no. 1, works at Delhi as Custom Clearance Agent hence petitioners promised to get the son of the complainant appointed for the salary of rupees ten thousand per month when he demanded seventy eight thousand rupees from the complainant and the same was given to the petitioners.
Patna High Court Cr.Misc. No.37323 of 2015 (2) dt.15-09-2015 2/2 It is submitted by the learned counsel for the petitioners that there is no proof with regard to the payment. It is further submitted that for the occurrence of 20.2.2012 the complaint was filed on 18.5.2012. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Madhubani in connection with Complaint Case No. 688 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
