JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302 of the Indian Penal Code.
As per the prosecution case, the informant suspects that petitioner has killed her husband due to old enmity on account of an occurrence which took place about 10 years ago. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is no eye witness of the occurrence and only on suspicion petitioner has been made accused in this case. It is submitted that petitioner along with deceased constructed a hutment over the public land in which exchange of hot words
Patna High Court CR. MISC. No.55267 of 2021(3) dt.28-06-2022 2/2 had taken place 11 years ago, the police came and only recommended for initiation of proceeding u/s 107 of Cr. P.C. and when the good relation restored the said proceeding was dropped. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Sadar (Muffasil) PS case No. 267/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
