JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-01-2019 The petitioner had filed this writ application for a direction to the respondents to make payment of admitted dues amounting to Rs. 92,000/- against the work conducted by the petitioner under District Water and Cleanliness Scheme, Nalanda.

A counter affidavit has been filed on behalf of respondent nos. 4, 5, 7, 8, 9 and 10. In paragraph 11 of the counter affidavit a statement has been made that an amount of Rs. 0.828 lacs (Rs. 82,800/-) has been paid to the petitioner vide Cheque No. 812854 dated 04.12.2014. It is pointed out that such

Patna High Court CWJC No.15513 of 2013(2) dt.02-01-2019 2/2 payments have been made on the verification of the work done by the petitioner by a third party i.e. the Block Development Officer of that Block.

In the aforesaid view of the matter, since the admitted amount has already been paid to the petitioner upon due verification, learned counsel for the petitioner does not press this writ application, however, he seeks liberty to raise his claims with regard to remaining dues. If any such claim is made, the same shall be considered by the authorities and a reasoned order thereon shall be passed within a period of 90 days from the date of receipt of claim of the petitioner along with certified copy of this order.
