====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 24-03-2021 Heard the parties.

The petitioner is languishing in custody for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a and 26 of the Arms Act. Petitioner is in custody since 27.12.2019. Name of the petitioner surfaced in the confessional statement of co-accused. Besides that there is no other material against the petitioner save and except the criminal cases mentioned in Para-3 of the bail petition. In this very case, there is no substantial material against the petitioner and the petitioner is in custody since last one year. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below

Patna High Court CR. MISC. No.776 of 2021(3) dt.24-03-2021 2/2 where the case is pending in connection with Kumarkhand P.S. Case No. 200 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
