JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-05-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Sherghaty (Dobhi) P.S. Case No. 597 of 2016 for the offences punishable under sections 147, 149, 341, 323, 324, 307, 379 and 504/34 of the I.P.C. Allegedly, the petitioner assaulted the informant with Khanti on his head causing rapture of head and bleeding and all assaulted him. The informant became unconscious and fell down and when his brother came to rescue he was also assaulted and further they took away Rs. 5,000/- from the cash box of the shop. Submission is of false implication and that there is case and counter case, the wife of the petitioner was assaulted and

Patna High Court Cr.Misc. No.14361 of 2017 (2) dt.17-05-2017 2/2 humiliated and for that Sherghaty (Dobhi) P.S. Case No. 598 of 2016 has been registered, the petitioner has also been assaulted by them, the injuries caused to the informant Prince Kumar are simple in nature caused by the hard and blunt substance and as such the petitioner deserves sympathetic consideration. The learned A.P.P. submits that the corresponding injury has been found though lacerated on the scalp. In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Sherghaty (Gaya) in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
