In the instant writ petition, petitioner has prayed for the following relief:- For a direction to the respondent number 4 to 7 to settle the land for home according to the circular of Bihar Government. The petitioner belongs to SC/ST and landless. He is residing on government land having made a home from 50 year bearing Khata Number 110, Plot Number 1053, Area .4 dismal, Thana Number 707 Anchal Rafiganj District Aurnagabad Bihar and after then he has taken electric line from electric department, government of Bihar in his mother and he deposite the electric bill to the government.
3. Learned counsel for the petitioner submits that
Patna High Court CWJC No.11803 of 2025 dt.24-07-2025 2/3 petitioner belongs to SC/ST category and is landless person and he is residing on government land. He further submits that Revenue Department, Government of Bihar has issued letter no. 4 Kha. Ma. Policy 101/712 2188 dated 12.05.1971 for settlement of land in respect of SC/ST category and others and the said letter has been annexed as Annexure-P/6 to the writ petition. Learned counsel for the petitioner further submits that the State Government is committed to provide land for home to landless Mahadalit families which is mentioned at Annexure-P/7 to the writ petition. Learned counsel further submits that petitioner has made representation before S.D.O., Aurangabad for settlement of government land (Annexure-P/3) but the concerned S.D.O.
has not passed any order on the representation of the petitioner. Learned counsel further submits that petitioner has also given representation before the Additional District Magistrate, Aurangabad for settlement of government land (Annexure-P/4) but the concerned authority has not paid any heed in respect of representation of the petitioner. He further submits that petitioner has also represented before the District Magistrate, Aurangabad for settlement of government land (Annexure-P/5) but up till now, grievance of the petitioner has not been redressed.

4. Learned counsel for the State has submitted that if the petitioner files fresh representation raising his grievance before the competent authority, the same shall be looked into.

Considering the facts and circumstances of the case and the arguments advanced on behalf of the parties, the present writ petition stands disposed of with liberty to the petitioner to file fresh representation before the competent authority for redressal of his grievance, as has been raised in the present writ petition, within a period of five weeks from the date of receipt of the order. If such representation is filed within the stipulated period, the concerned authority is directed to consider and dispose of representation of the petitioner by giving him due opportunity of hearing as per provision of law without being prejudiced by the order passed by this court expeditiously, preferably within a period of three months from the date of filing of representation.
