It is contended by the learned counsel for the petitioner that inadvertently, the Advocate Clerk failed to mark the case in the cause list on 19th August, 2016, as a result of which, the counsel for the petitioner could not appear in the Court, on call.

Regard being had to the submission made at the Bar, the prayer is allowed.
