JUSTICE SANDEEP KUMAR ORAL ORDER 25-11-2021 At the very outset, learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail application as against petitioner No. 1 (Nikhil Rajak @ Nikhil Kumar).

Permitted to be withdrawn.

It is, thus, dismissed as withdrawn as against petitioner No. 1.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Mednichauki P.S. Case No. 70/20 registered for the offences punishable under Sections 341/323/302/34 of the

Patna High Court CR. MISC. No.40391 of 2020(3) dt.25-11-2021 2/2 Indian Penal Code.

It is submitted by learned counsel for the petitioner that occurrence took place because of land dispute and the deceased had fallen down and sustained some injuries. Though, as per the prosecution, he was assaulted by the petitioners.

Considering the genesis of the occurrence and the nature of injury, the present anticipatory bail application is allowed.

Accordingly, let the petitioner No. 2 Ravindra Rajak @ Rabbu Rajak, be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Lakhisarai in connection with Mednichauki P.S. Case No. 70/20, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
