Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms

As per the prosecution case, petitioner No.7, Chhotu Pandey and co-accused, Vishal Singh, abused, grabbed hair of the informant and put her down on the ground due to which she became naked. It is further alleged that all the accused persons threw bricks and stones on the informant's family members and petitioner No.7, Chhotu Pandey, opened firing from his fire arm thereafter petitioner No.7 and co-accused, Vishal Singh, snatched golden chain from the neck of informant. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that specific allegation of assault and firing is against petitioner No.7, Chhotu Pandey, and co-accused Vishal Singh and there is no allegation of firing against petitioners No.1 to 6. Petitioners have got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners 1 to 6, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.55899 of 2021(2) dt.30-06-2022 3/3 each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya (Banjariya) PS case No. 271/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.

Since there is specific allegation of firing against petitioner No.7, Ankit Raj @ Chotu Pandey, I am not inclined to enlarge petitioner No.7 on anticipatory bail. Accordingly, the same is rejected.
