JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Sections 30(a)/36 of the Bihar Prohibition and Excise Act.

As per prosecution case, 612.450 litres foreign liquor has been recovered from Maruti Omni Car.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and in no way his is connected with the aforesaid recovery. Petitioner is neither driver nor owner of the vehicle in question. Petitioner has clean antecedent. Considering the aforesaid facts and circumstances, let

S. Case No. 106 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
