JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-12-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Begusarai Muffasil P.S. Case No.221 of 2017, registered for the offence punishable under Sections 394/302 of Indian Penal Code.

The petitioner is in custody since 20.07.2017. His prayer for regular bail was earlier rejected by an order dated 07.01.2021 passed in Cr. Misc. No. 31531 of 2020, considering the nature of accusation against him and his involvement in other criminal cases as noted in the order itself. There was an observation made in the said order that if there was no substantial progress at the trial, the petitioner shall be at liberty to renew his prayer for bail after six months. Patna High Court CR. MISC. No.56194 of 2021(3) dt.22-12-2021 2/2 application has been filed renewing the prayer for bail. By an order dated 24.11.2021, this Court had called for a report from the Court below as regards present stage of the trial arising out of the concerned Begusarai Muffasil P.S. Case No.221 of 2017. A report has been received from the learned Additional District and Sessions Judge-IV, Begusarai, from which it appears that the case is running before the Court below for framing of charge.

Considering the fact that the petitioner has remained in custody since 20.07.2017 and even the charge has not been framed, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV, Begusarai, in Begusarai Muffasil P.S. Case No.221 of 2017.
