====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 23-10-2024 The record has been taken up on mentioning being made on behalf of the petitioner.
2. Heard learned counsel for the petitioner.
3. The petitioner is aggrieved by the order dated 15.05.2024 passed by learned Principal Judge, Family Court, Kaimur at Bhabua in Maintenance Case No. 69 of 2022, whereby the whereunder the learned trial court directed the petitioner to make payment of Rs.10,000/- to the respondentwife. This amount of interim maintenance is inclusive of the amount of Rs.5,000/- which the petitioner was directed to pay vide order dated 16.05.2023 passed in Cr. Misc. No. 72130 of 2022 and as it appears from the record that this order was passed at the instance of the petitioner.
Patna High Court C.Misc. No.790 of 2024(2) dt.23-10-2024 2/2
4. From perusal of the impugned order, I do not find any material showing any infirmity. It is a well discussed order. Moreover, the impugned is only with regard to payment of the interim maintenance amount and the petitioner is still at liberty to raise all issues before passing of the final order in the maintenance case.
5. Therefore, I do not find any merit in the present petition and the same is dismissed.
6. However, learned trial court is directed to expedite the matter and dispose of the maintenance case within a period of six months from the date of receipt/production of a copy of this order.
