The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. It is alleged that the accused persons came variously armed, assaulted the informant with lathi. On alarm being raised then Venktesh Sharma and Suresh Singh came to rescue, they were also assaulted. It is further alleged that coaccused Chandan Singh took way gold chain from the neck of Venktesh.

It is submitted by learned counsel for the petitioner that the informant has received only one injury,

No.35997 of 2015 (2) dt.04-09-2015 2/2 though, the same has been found on the occipital region, but the same has been found to be grievous when the accusation of making assault by other persons. The injuries of Venktesh Sharma and Suresh Singh were found to be simple. Petitioner side at earlier point of time lodged Mahendia P.S. Case No. 34 of 2015 and petitioner side have also received grievous injury. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Mehandia P.S. Case No. 38 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
