The petitioners apprehend their arrest in Khagaria (Chitragupta Nagar) P.S. Case No. 395 of 2016, registered for the offences punishable under Sections 323, 420, 406, 467, 468, 471, 120(B) & 149 of the Indian Penal Code.
The informant filed a complaint case on the basis of which the present FIR is lodged. The informant alleged that he purchased land of Khata No. 94, Khesra No. 55, Area 10 Dhur, Tauji No. 525, Thana No. 271 from Awadhesh Bihari Sharma but Ram Bilas Tanti, son of Awadh Bihari Sharma sold the same land in favour of Sunaina Kumari. Petitioners are the identifiers of the
Patna High Court Cr.Misc. No.39807 of 2016 (2) dt.20-09-2016 2/2 vendor in the executed sale deed.
It is submitted that the petitioners have not committed any misdeed or illegality. Petitioners are only witnesses of the sale deed.
On the other hand, learned counsel for the informant as well as learned Additional P.P. opposed the prayer for anticipatory bail.
It appears that the petitioners are witnesses of the sale deed and identifier of the vendor.
Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 395 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
