JUSTICE RAKESH KUMAR ORAL ORDER 05-09-2018 The sole petitioner, apprehending his arrest in a case which was lodged long back i.e. in the year 2014 vide Gaya Mufassil P.S. Case No. 452 of 2014, registered for the offence under Sections 272/273 of the Indian Penal Code, 1860 and Section 47 (A) of the Bihar Prohibition And Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

Sri Chandra Bhushan Prasad, learned Additional Public Prosecutor submits that petitioner was named as accused in the F.I.R. which was lodged in the year 2014, accordingly, there is no reason to entertain anticipatory bail petition. On perusal of the statement made in paragraph no. 3 of the petition it is evident that petitioner was also accused in an another case. Moreover, considering the fact that petitioner

Patna High Court Cr.Misc. No.38115 of 2018(6) dt.05-09-2018 2/2 was made F.I.R. named accused in the year 2014, in the month of September, 2018, there is no reason to entertain anticipatory bail petition.
