JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in Deoria P.S. Case No.51 of 2016 for the offence under Section 304 (B) of the I.P.C.

Accusation is of torturing and killing of the daughter of the informant, Vibha Devi by her husband and inlaws due to non-fulfillment demand of a motor cycle and cash of Rs.50,000/- in dowry.

Learned counsel for the petitioners submits that the petitioners are brother-in-law and sister -in-law of deceased. In fact, deceased committed suicide herself due to frustration and

Patna High Court Cr.Misc. No.12793 of 2017 (5) dt.18-07-2017 2/2 also wrote a letter in her diary. In the post mortem report the doctor has opined the reason of death of the deceased due to asphyxia as a result of ante mortem hanging. Further submission is that the Tarkeshwar Das husband of the deceased is in custody since 29.6.2017.

Having considered the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Sri A. K. Singh, J.M., 1st Class, Muzaffarpur, in Deoria P.S. Case No.51 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
