In this case, the petitioner is apprehending his arrest in connection with Sakri P.S. Case No. 79 of 2018 (CRI No. 1135 of 2018) registered for offences under sections 395 of the Indian Penal Code.

As per allegation, the Informant along with codriver was carrying chilly on the vehicle from Phulwari to Patna which was looted away by the accused persons. Later on, the chilly along with vehicle was recovered and seized by the police.

The name of the petitioner has surfaced during investigation.

The petitioner carries three criminal cases on his

Patna High Court CR. MISC. No.44090 of 2019(2) dt.18-07-2019 2/2 head, all related to the Excise Act.

Learned counsel for the petitioner submits that the brother and driver have already been granted regular bail by this Court.

Looking to the entire facts and circumstances of the case as also the petitioner having criminal antecedent, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of three weeks from today and makes a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law.
