Petitioner apprehends his arrest in Phulwaria P.S. Case No. 100 of 2015 registered, on amongst others, under section 307 IPC and Section 27 of the Arms Act.
Allegation attributed to him is of firing from pistol hitting the informant near the right armpit.
Contention of the counsel for the petitioner is that owing to land dispute the occurrence had taken place. The informant received two injuries which have been opined to be simple in nature.
Counsel for the State has opposed the application submitting that the allegation of firing and hitting the informant is attributed to the petitioner. Land dispute may be a motive to do so.
Patna High Court Cr.Misc. No.25897 of 2016 (2) dt.04-07-2016 2/2 Be that as it may, considering the allegations levelled against the petitioner and corresponding injury suffered by the informant, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Prayer is rejected.
