The petitioner apprehends his arrest in Chowk P.S. Case No. 05 of 2015 instituted for the offence under Section (s) 420, 406, 341, 323, 34 of the Indian Penal Code. It has been submitted that petitioner is merely the witness on the deed of agreement.
It has been mentioned in para 8 of the complaint that petitioner put signature as one of the witnesses on the deed of agreement in which the date was extended for executing the sale deed for four months.
In this manner, besides this, there is no
Patna High Court Cr.Misc. No.7382 of 2017 (2) dt.22-02-2017 2/2 allegation of overt act against the petitioner. In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Chowk P.S. Case No. 05 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City, Patna, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
