JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-09-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Excise Case No. C-III 163 of 2020 for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
The accusation is that in course of raid, in front of Laundry shop of petitioner Dil Mohammad, the petitioner and one Nazir Alam were seen, when informant along with other Police personnel reached there then petitioner Dil Mohammad fled away from there while Nazir Alam was apprehended with a bottle containing 600 ML Indian Made Foreign Liquor. Learned counsel for the petitioner submits that petitioner was not apprehended on the spot and his name
Patna High Court CR. MISC. No.1596 of 2021(2) dt.06-09-2021 2/2 surfaced in this case because co-accused Nazir Alam was found sitting in front of laundry shop of petitioner. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Excise Case No. C-III 163 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
