====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-12-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Learned counsel for the petitioner is directed to remove the defects within four weeks.
Petitioner apprehends his arrest in a case registered for offence punishable u/s 363, 366, 366A of IPC. Allegedly, the petitioner enticed informant's minor daughter and taken her away with him. Petitioner is already married man and wants to marry with informant's daughter. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to political rivalry. The allegation leveled against the petitioner is false, fabricated and concocted. No such occurrence, in the manner as alleged,
Patna High Court CR. MISC. No.45278 of 2022(2) dt.01-12-2022 2/2 has ever taken place. It is further stated that the victim herself went to Patna with petitioner which is clear from the statement of victim girl. Petitioner has no criminal antecedent. Learned APP for the State opposed the prayer for bail. Considering the facts and circumstances of the case, since the victim girl is minor, I am not inclined to enlarge him on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.
This application is accordingly dismissed.
