2. The petitioners apprehend their arrest in connection with Complaint Case No. 703 of 2013 in which cognizance has been taken by the concerned Court under Sections 323, 380, 504 / 34 of the Indian Penal Code.
3. As per the complainant, the allegation against the
Patna High Court CR. MISC. No.49667 of 2023(2) dt.11-08-2023 2/3 petitioners is that they armed with deadly weapons entered into the house of the complainant and snatched her jewellery and Rs. 50,000/-.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Co-accused Akhilesh Sao is the informant of Immamganj P.S. Case No. 48 of 2012 registered under Section 302 of the Indian Penal Code, in which complainant's husband is an accused and for taking revenge the complainant has filed this false case against the petitioners. Petitioner Nos. 1 and 2 are brother-in-law (Nandoshi) and petitioner No. 3 is sister-in-law (Nanad) of the complainant. He further submits that petitioners have no criminal antecedent.
5. Learned A.P.P. opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of their arrest or surrender before the Court below within six weeks from today, the above named petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sherghati
