The petitioner is apprehending his arrest in connection with Jamhore P.S. Case No. 37 of 2016 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code. Allegation against the petitioner is that Rs.6,06,224/- was allotted to the School Education Committee, Primary Schoo, Amar Bigha, of which petitioner was Headmaster, for execution of construction works but he has got the work done for Rs.4,54,668/- and rest amount was withdrawn by him but he has not completed the work and misappropriate the said amount.

However, it has been submitted on behalf of the petitioner that by now petitioner has completed the work and rest amount of Rs.90,000/- and odd has been deposited by him through cheque, which is evident from Annexure-2 to the petition.

Having heard both sides and in view of the fact that now petitioner has completed the work and rest amount has been deposited by him, as such, let the petitioner, named above, in the event of his arrest or surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Jamhore P.S. Case No. 37 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall cooperate in the investigation and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bonds and further petitioner will not induce any witness or tamper with the evidence.
