Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The prosecution case as per F.I.R is that purse of the wife of the petitioner containing cash of Rs.

Patna High Court CR. MISC. No.55104 of 2021(2) dt.18-04-2022 2/3 56,000/- and a golden ring, mobile phone, etc was stolen by some unknown person while she was traveling from Patna to Raipur by train. The name of the petitioner sprang up since the SIM used in the stolen mobile was in the name of the petitioner which gets reflected from Paragraph Nos. 48 and 49 of the case diary.

It is submitted by learned counsel for the petitioner that the F.I.R has been registered against unknown. Nothing has been recovered from the conscious possession of the petitioner. The stolen articles have not yet been recovered from anyone. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)
