Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State.

Petitioner seeks bail in connection with Ramgarhwa P. S. Case No.157 of 2020 registered for the offences punishable under Sections 20, 22, 23, 34 of the Narcotics Drugs and Psychotropic Substance Act.

As per prosecution case, 1100 grams of Ganja was recovered from the possession of the petitioner. It is submitted that the recovery is much less than the

Patna High Court CR. MISC. No.40771 of 2020(3) dt.09-04-2021 2/2 commercial quantity and the mandatory provisions with regard to search and seizure has not been followed. Petitioner is in custody since 02.07.2020 and charge-sheet has already been submitted against the petitioner.

Considering the quantity of recovery and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S. Act, East Champaran at Motihari in connection with Ramgarhwa P. S. Case No.157 of 2020. (Prabhat Kumar Singh, J) vikash/- U T
