====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-05-2021 Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Considering the allegation of recovery of fire arm as well as allegation of being a member of miscreants which were preparing to commit dacoity, coupled with criminal antecedents of the petitioner, I am not inclined to enlarge the petitioner on bail in connection with Minapur P.S. Case No. 247 of 2020. Hence, prayer is refused.

Since the petitioner is in custody since 04.07.2020,

Patna High Court CR. MISC. No.1239 of 2021(3) dt.21-05-2021 2/2 learned trial Judge is directed to expedite the trial. The petitioner may renew prayer for bail before the court below itself after framing of the charge or after six months from today whichever is earlier.
