The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 324, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner, allegedly, caused firearm injury at the thigh of the informant.
Learned counsel for the petitioner submits that the occurrence, allegedly, took place for land dispute. The petitioner has got no criminal antecedent and has been falsely implicated in this case.
The injury report reveals that the informant had sustained firearm injury at the left thigh, simple in nature. Considering the nature of allegation against the
Patna High Court Cr.Misc. No.17474 of 2017 (2) dt.13-04-2017 2/2 petitioner, I am of the view that this is not a fit case for anticipatory bail in connection with Bikram Police Station Case No. 43 of 2016 pending in the court of learned Additional Chief Judicial Magistrate, Danapur, Patna/successor Court. Hence, prayer for bail is refused.
However, on prayer of the petitioner for regular bail in the event of surrender, the learned court below shall dispose of the same without being prejudiced by this order. Accordingly, this application stands disposed of. (Birendra Kumar, J) Kundan U T
