The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420,468,470 and 478 of the Indian Penal Code. It is alleged that the accused persons collected Rs.11,23,000/- from the informant and others for providing government employment. It is alleged against co accused Indra Kishore Choudhary, Ashok Kumar Singh, Sujit Kumar Singh and petitioner no. 2 Devendra Singh that they were handed over educational certificates, residential proof and other documents when the money

Patna High Court Cr.Misc. No.38693 of 2015 (2) dt.28-09-2015 2/3 was handed over to co accused Indra Kishore Choudhary and Ashok Kumar Singh. It is alleged against petitioner no. 1 that she being wife of petitioner no. 2 was also the part of conspiracy.

It is submitted by the learned counsel for the petitioners that it is not alleged that the money was ever handed over to the petitioners. The accusation of handing over the documents is omnibus and general. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

It is submitted by learned counsel for the informant that the petitioners and others defrauded several persons and huge amount of money was taken for providing employment.

Considering the fact that the entrustment of money is not against the petitioners, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Sheohar in connection with Sheohar P.S. Case No. 74 of
