The petitioners apprehend their arrest in Mufassil P.S. Case No. 333 of 2016 instituted for the offence under sections 341, 323, 324, 308, 325, 448 and 504 of the Indian Penal Code.

It has been submitted that there is no allegation of any specific overt act against petitioner no.1. The petitioner no.2 assaulted the informant with Farsa but no any description of injury has been given by the informant.

Case diary has been called for.

The injury of the informant is mentioned in Para-16 of the case diary wherein the doctor has found one fracture on left

Patna High Court Cr.Misc. No.7896 of 2017 (3) dt.21-03-2017 2/2 fore-arm which is non-vital part of the body. The other injury on the person of the informant has been found to be simple in nature.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners named above, within six weeks from today, in connection with Mufassil P.S. Case No.333 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, subject to the conditions as laid down under Section 438(2) Cr.P.C.
