JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Tajpur (Halai O.P) P.S. Case No. 140 of 2015 instituted for the offence under sections 147, 148, 149, 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that altercation took place on account of putting pillar over the land between the parties. There is specific allegation against co-accused Vinay Rai of causing fire-arm injury on the chest of the informant.

There is general and omnibus allegation against this petitioner.

It has further been submitted that other co-accused with similar allegation has been granted bail by a coordinate

Patna High Court Cr.Misc. No.11622 of 2017 (2) dt.20-03-2017 2/2 Bench of this Court in Cr. Misc. No. 29613 of 2016 vide order dated 30.08.2016.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Tajpur (Halai O.P.) P.S. Case No. 140 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Samastipur, subject to the conditions as laid down under Section 438(2) Cr.P.C.
