The petitioner apprehends his arrest in Hilsa P.S. Case No. 140 of 2016 instituted for the offence under Section(s) 147, 148, 149, 447, 324, 323, 307, 380, 504 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged in the written report that on the date of occurrence, the petitioner and other accused persons attacked the house of the informant. The petitioner shot fire upon the informant which did not hit the informant. It is further alleged that accused persons kidnapped the informant and this petitioner gave Chura blow on his leg. The other accused persons started assaulting the informant with the butt of the pistol with an

The injury report has been brought on record as Annexure-2 which reflects that the doctor has found one injury on ankle, simple in nature. There is no repetition of the blow. It has been mentioned in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Hilsa P.S. Case No. 140 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 2nd, Hilsa, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
