JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in Sahebganj P.S.Case No.281/16 for the offence under Section 380 of the I.P.C.
The allegation of the informant is that on 23.12.2016 at about 7.30 P.M. on hearing the sound of khat khat when his brother Pappu Kumar Ram woke up and entered into the house in the flash of torch light Ravi Ranjan Kumar Patel @ Maruti Nandan was seen fleeing away through the roof of Rajeshwar Rai. In the meantime, Rahul Kumar son of Baidyanath Ram, who happens to be the friend of Maruti Nandan
Patna High Court Cr.Misc. No.17053 of 2017 (2) dt.16-05-2017 2/2 was also apprehended who admitted his guilt about committing theft of gold chain, ear ring and some cash.
Learned counsel appearing on behalf of the petitioner submits that the petitioner being the co-villager of the informant has falsely been implicated in this case mere on suspicion without any overt act. Further submission is that the petitioner has not criminal antecedent.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., West Muzaffarpur, in Sahebganj P.S.
