JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-04-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceeding. The petitioner seeks bail in connection with Session Trial No.289/2016 /(200/2016) arising out of Konch P.S. Case No.146/2014 registered for the offence punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code. The allegation against the petitioner is that he along with other accused persons has killed the husband of the informant by firing.

Earlier, the bail applications of petitioner has been rejected by order dated 07.04.2017 in Cr.Misc. No.16057/2017, order dated 10.10.2018 passed in Cr.Misc. No.48388/2018 and order dated 25.09.2019 passed in Cr.Misc.No.49457/2019.

Patna High Court CR. MISC. No.1519 of 2021(3) dt.08-04-2021 2/2 It is submitted by learned counsel for the petitioner that out of thirteen witnesses mentioned in the chargesheet, only six witnesses have been examined till date and petitioner is in custody since 24.02.2015.

In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby rejected.

However, learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within six months from the date of receipt/production of a copy of this order. Both the parties are expected to extend their co-operation in conclusion of the trial. The Superintendent of Police, Gaya is directed to ensure production of the witnesses in the case on each and every date fixed without fail.

Let a copy of this order be sent to the Superintendent of Police, Gaya for needful.
