Petitioner apprehends arrest in connection with Motihari Town P.S. Case No. 3 of 2020 registered for the offence punishable under sections 495, 420 and 34 of the Indian Penal Code and section 3/4 of the Prohibition Act. Learned counsel appearing for the petitioner and the opposite party no.2 jointly submit that the parties are ready to settle their dispute on the following terms : "A total amount of Rs. 15,00,000/- would be paid to the opposite party no. 2 by the petitioner. 1st
Patna High Court CR. MISC. No.3247 of 2021(9) dt.10-03-2022 2/2 installment of 30% i.e. 4,50,000/- will be paid at the time of signing the compromise petition. 2nd installment of 30% i.e. 4,50,000/- will be paid at the time of disposal of cases in the court below and the 3rd installment of 40% i.e. 6,00,000/- would be paid at the time of final disposal of divorce suit." Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties as also taking into consideration the the terms of settlement, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sadar at Motihari, East Champaran in connection with Motihari Town P.S. Case No. 3 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C.
