JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

As per prosecution case, 15 litre country made liquor has been recovered from Ramnagar Hata village road. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and in no way his is connected with the aforesaid recovery. It is further submitted that petitioner has only been made accused on the basis of confessional statement of co-accused Santosh Kumar. Petitioner has no criminal antecedent.

No.45601 of 2022(2) dt.21-10-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge Court no. 2, Buxar in Nawanagar (Sonbarsa O.P.) P. S. Case No. 164 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
