JUSTICE PRABHAT KUMAR JHA ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned counsel for the State. The petitioner apprehends his arrest in Sonepur P. S. Case No. 367 of 2016 registered for the offences under Sections 341, 323, 384, 504, 498A and 34 of the Indian Penal Code and Sections 3 & 4 of the Dowry Prohibition Act. The informant who is the wife of the petitioner made allegation against the petitioner that the petitioner subjected her to physical and mental torture for non-fulfillment of additional demand of dowry.
Leanred counsel for the petitioner submits that the petitioner is ready to keep his wife. On such, willingness notice was issued to the informant and the informant appeared from her
Patna High Court Cr.Misc. No.12762 of 2017 (3) dt.25-04-2017 2/2 Naihar.
Learned counsel for the informant submits that she is also ready to live with her husband, but her husband on one pretext or the other, does not want to keep her. Considering the facts that both husband and wife are willing to live together, the petitioner above named is directed to surrender in the court below and the court below shall enlarge the petitioner on provisional bail for four months on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Chapra in Sonepur P.S. Case No. 367 of 2016, subject to the conditions as laid down under Section 438(2) of this Cr.P.C. The court below shall thereafter make efforts for reconciliation of the dispute between the husband and wife.
If the petitioner keeps his wife properly, the learned court below shall confirm the provisional bail granted to the petitioner and if the petitioner fails to keep his wife properly, the learned court below shall pass order in accordance with law immediately after lapse of four months on the provisional bail of the petitioner.
