====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2023 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code.
3. As per prosecution case, co-accused Priyanshu Kumar kidnapped minor daughter of the informant. These petitioners are alleged to have assisted the co-accused Priyanshu Kumar in the kidnapping.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.47378 of 2023(5) dt.13-12-2023 2/2 specific accusation of kidnapping daughter of the informant is against co-accused Priyanshu Kumar @ Pappu who has already been granted anticipatory bail by learned Special Judge, POCSO cum Additional District and Sessions Judge-VI, Gaya in A.B.P. No. 982 of 2023 vide order dated 09.05.2023 (Annexure-2). Petitioners are only alleged to have assisted the co-accused Priyanshu Kumar @ Pappu in the alleged kidnapping. Petitioners claim clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Belaganj P. S. Case No. 68 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
