JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2017 The petitioner is apprehending his arrest in connection with Kalyanpur P.S. Case No. 259 of 2016, registered for offences punishable under Sections 376 and 506 of Indian Penal Code. Allegation against the petitioner is that he repeatedly made physical relation with the informant on the pretext of marriage and when the informant became pregnant, petitioner denied to marry her.

It has been submitted on behalf of the petitioner that now the parties have compromised their disputes and a compromise petition has also been filed by the informant, which is annexed with this petition as Annexure -2.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.18000 of 2017 (2) dt.02-05-2017 2/2 circumstances of the case and the nature of allegation, I am not inclined to grant the petitioner privilege of anticipatory bail. Let petitioner surrender before the court below and pray for regular bail and if any such application is filed, the court below after considering the submission of learned counsel for the petitioner, shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court. With the above observation, this application is disposed of.
