2. The instant writ application has been filed for the following relief(s):- (i) For direction upon the respondent authorities to evict the encroacher from House No. - L.H.R/84, sector 2, Barari Housing Colony, Bhagalpur, who has encroached the said house, since and subsequently, declared

Patna High Court CWJC No.10172 of 2026(2) dt.23-07-2026 2/3 encroachers by the Competent Authority, in a proceeding initiated under Section 59 of the Bihar State Housing Board, vide order dated 26/05/2025 passed in Eviction Case No. 02/2024.

(ii) For direction upon the respondent no. 6 & 7 to provide police force to the respondent Board, upon their requisition, for forceful eviction of the encroacher from House No. L.H.R./84, Sector 2, Barari Housing Colony, Bhagalpur.

(iii) To pass such other order/orders as Your Lordships may deem fit and proper in the fact and circumstances of the case.

Learned counsel for the petitioner submits that the eviction proceeding to get the House No. L.H.R./84 evicted under Section 59 of the State Housing Board Act, 1982 was initiated and final orders has already been passed by the authorities of Bihar State Housing Board vide Order dated 22.05.2025 passed in Eviction Case No. 02/2024 but, despite final orders having been passed, no such follow up action has not been taken to get the said House No. L.H.R./84 encroachment free to allow this petitioner to avail the fruits of such allotment.

4. On the other hand, Shri Pawan Kumar, who appears for the Bihar State Housing Board, Patna submits that since final orders in Eviction Case No. 02/2024 has already been

Patna High Court CWJC No.10172 of 2026(2) dt.23-07-2026 3/3 passed by the competent authority of Bihar State Housing Board appointed under the Act duly initiating proceeding, therefore appropriate directions may be issued to bring the said eviction proceeding to a logical conclusion.

Considering the above submission and the fact that the final orders have already been passed and, in such event, it is expected that the Managing Director, Bihar State Housing Board, Patna shall take appropriate measures to implement the order dated 22.05.2025 passed in Eviction Case No. 02/2024 by ensuring eviction of the unauthorized occupants from the House bearing No. L.H.R./84 within a period of four weeks from today.

6. With the aforesaid observation and direction, the writ petition stands disposed of.
