The petitioner apprehends his arrest in Sugauli P.S. Case No. 246 of 2016 registered for the offences punishable under Sections 420, 467, 468, 439, 406, 384, 504 and 120(B) of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.

The informant filed Complaint Case No. 2194 of 2016 on the basis of which the present FIR was registered. The informant alleged that he gave Rs. 5 lakh to Sudama Prasad, father of the petitioner for marriage of the petitioner with daughter of the informant but the informant himself stated that there is no documentary evidence to show that he gave Rs. 5 lakh to the father of the petitioner. The informant further alleged that

Learned counsel for the petitioner submits that the petitioner is a bridegroom and he has no talk with the informant. The petitioner did not receive any farthing and not demanded dowry.

Considering the facts aforesaid the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Sub-Divisional Judicial Magistrate, Sadar, Motihari in Sugauli P.S. Case No. 246 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
