JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2017 The petitioner is apprehending his arrest in connection with Halsi P.S. Case No. 37 of 2016, registered for offences punishable under Sections 467, 468, 471, 419, 420 Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner took over the charge of Sirkhandi panchayat on 01.10.2014 and at that time no papers were handed over to him as such he could not submit/deposit the file/folder with regard to appointment of Niyojit Teacher and in spite of the said fact, this case has been lodged against the petitioner.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, let petitioner above named, in the event

Patna High Court Cr.Misc. No.14805 of 2017 (2) dt.03-04-2017 2/2 of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on provisional bail till submission of chargesheet, on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Lakhisarai in connection with Halsi P.S. Case No. 37 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. This is further subject to the condition that:- Petitioner shall cooperate in the investigation and shall produce all the relevant file/folders, if it is in his possession, as required by the Investigation Officer.

Further, if any incriminating material comes against the petitioner in the charge-sheet, apart from what is at present, the provisional bail granted to the petitioner shall stand automatically cancelled, otherwise, provisional bail granted to the petitioner shall be confirmed.

With the above observation, this application is disposed of.
