2. The petitioner apprehends arrest in connection with Sasaram (M) P.S. Case No. 366 of 2004 dated 12.08.2004 instituted for the offence punishable under Sections 304(B) of the Indian Penal Code.

3. Allegation against the petitioner and other co accused persons is that they demanded Rs. 50,000/- in cash and one Hero Honda motorcycle from the daughter of the informant

Patna High Court CR. MISC. No.47731 of 2024(2) dt.10-07-2024 2/3 as additional dowry, and due to non-fulfillment of the same, they tortured her physically and mentally. Consequently, on 24.07.2004, they killed her daughter by administering poison for the said dowry.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that petitioner is the younger brother of the husband of the deceased. It is next stated that there is no specific allegation against the petitioner rather the allegations are general and omnibus in nature. Further submission is that similarly situated co-accused have been granted anticipatory bail by this vide Cr. Misc. No. 80886 of 2023 (Annexure-4)). Lastly, it has been submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in Sasaram (M) P.S. Case No. 366 of 2004, subject to the conditions laid down
