The petitioner being husband of the deceased apprehends arrest in a case registered for the offences punishable under sections 304(B) and 120(B) of the Indian Penal Code. It is submitted that the petitioner was at Delhi to earn his livelihood. The victim herself committed suicide but it appears that the informant and other witnesses have very categorically made allegation against the petitioner that he subjected his wife to torture and at the instigation of the petitioner, his brother Sanjit Bhagat strangulated the wife of the petitioner to death.

Considering the facts aforesaid, I am not inclined to grant privilege of anticipatory bail to the petitioner in

Patna High Court Cr.Misc. No.38714 of 2015 (3) dt.30-11-2015 connection with Murliganj P.S. Case No. 71 of 2015 pending in the court of the learned Chief Judicial Magistrate, Madhepura. This application is, accordingly, rejected.
