2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Bariyarpur P.S. Case No. 10 of 2025, lodged on 07/01/2025, under Section 126(2), 115(2), 109, 303(2), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioner with allegation against the petitioner that he along with others have assaulted the informant with iron rod due to which the informant fell down on the ground and sustained injury.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the dispute as per the FIR has arisen only due to doing the 'patwan work' and for the connection of an electricity wire the dispute has arisen between the informant and the petitioner. Counsel specifically submits that both are agnates and basically the cousin and only on petty disputes of running the wire over the land, the dispute has arisen and due to which case and counter case has been filed between both sides. Counsel submits that the earlier case has been filed by the petitioner side, which is Annexure P/2. Counsel submits that the criminal antecedent of the petitioner is clean. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

5. Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that there is case and counter case between the parties.

6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand)
