The petitioner is languishing in custody for the offences punishable under Sections 363/366A of the Indian Penal Code and Sections 9/11 of the Child Marriage Act. Statement of the victim girl, recorded under Section 164 Cr.P.C., would reveal that the petitioner wanted to marry with her and for the purpose of marriage petitioner had taken her to the referred temple. However, the victim declined to marry with the petitioner. No other allegation is there against the petitioner.
Submission is that the matter is of love affairs. Considering the aforesaid facts, let the petitioner,
Patna High Court CR. MISC. No.46387 of 2019(2) dt.29-07-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Pipra P.S. Case No.29 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
